“小产权房” 清理工作是国家为了维护我国的土地使用秩序、保护耕地、控制建设用地使用规模、保护自然生态环境而进行的整治行动。20世纪90年代初，“小产权房”尚处于法律的真空模糊地带，建宁市建北区太平镇海棠村 村委会为带动集体经济发展，建设并销售了一批“小产权房”。随着“小产权房”规模不断扩大，一系列遏制“小产权房”的政策陆续出台。本案例讲述了海棠村里的“小产权房”房主们面临突如其来的限期拆除令，表现出的困惑、反抗与无奈，展现出“小产权房”清理行动中基层政府面临的执行难题。考虑到政策过程模糊性，公共治理者如何在法律与民生、政策绩效与经济社会发展之间保持平衡，而非一刀切，是一个十分现实而又紧迫的课题。

英文摘要：

“Handling houses with limited property rights” is an important remediation of China’s Land Policy. It concerns not only the mantainence of the Land Use Order, which asks for the protection of the cultivated land and the scale regulation of Construction Land, but also the protection of ecological environment. In the 1990s, there were no relevant laws about the houses with limited property rights . In order to promote the development of economy, the village committee of Haitang Village in Taiping Town,Jianbei District,Jianning City had built and sold many houses which are defined as “houses with limited property rights ” now. With the number of the houses with limited property rights increasing promptly, a series of revelant laws have been made for its reduction. This case is about the house owners in Haitang Village facing the unexpected rectification actions and feeing confused, struggling and helpless. At the same time, it shows the implementation difficulties that the grass-roots governments are faced with. Considering the ambiguity of policy process, it’s a realistic and urgent topic for public administrators to balance laws and people’s livelihood, law effects and economic social effects, instead of cutting without differentiation.
